Visa Debit Terms of Use Private Customers

Version 1.1 - Effective from 23rd of April 2021

1. Card type

You can receive a Visa Debit card associated with an account in Lunar Bank.

With Visa Debit cards, you can, by default, only withdraw or purchase for the amount in your account; it is a debit card with balance checking. See also section 5.2

2. The use of the card

The card can be used as a payment card and debit card in Sweden and abroad. You may not use the card for illegal purposes, including the purchase of goods or services that are illegal under local law.

2.1 Using the card as a debit card in Sweden and abroad

Visa Debit can be used:

  • for cash withdrawals from ATMs where Visa can be used. The maximum amount that can be paid per day is specified in the price list, which is available in the Lunar app, at www.lunar.app, or upon request.
  • for cash withdrawals at the check-out at cash disbursement points connected to Visa. The cash disbursement point may set restrictions on the withdrawal.

2.2 Use of the card as a payment card in Sweden and abroad

You can use Visa Debit to pay for goods and services at stores, including Internet stores that accept Visa.

You can use the contactless feature on the card, see section 5.8.

Visa Debit on mobile can only be used for physical trading with payees who accept contactless cards. It will be clear from signage in the store or on the website whether a business accepts Visa. Businesses that accept Visa Debit will have a sign with the Visa logo.

Each business may have rules for limiting its use. Lunar Bank and Nets accept no responsibility for the payee's refusal to accept the card as a means of payment. If you have a credit in a store, the business will be able to deposit the money into your account via your card.

2.3 Maximum amount for Visa Debit

A maximum amount per day is set for the use of Visa Debit for payments and cash withdrawals. The maximum amounts are specified in the price list, which is available in the Lunar app, at www.lunar.app, or upon request.

2.4 Withdrawing amounts from your account

Immediately after Lunar Bank has been notified of the transaction, the amount is reserved in the account. Thus, you can no longer manage the reserved amount, although the amount can be seen in the account. The amount can be reserved for up to 7 days. The amount is withdrawn from the account when the payee requests it.

As a rule, purchases and withdrawals will be withdrawn from your account on the same day that you make a purchase or withdrawal. However, the timing of the withdraw on the account will depend on when Lunar Bank receives the transaction.

Lunar Bank cannot remove a reserved amount as it is only an outstanding account between the business and the customer.

2.5 Maximum amount

You may only withdraw money or buy for the amount in the account unless you have agreed otherwise with Lunar Bank. The amount may be reserved, as mentioned above. For payment or withdrawal in foreign currency, the amount is converted into Swedish kroner, cf. the price list, which is available in the Lunar app, at www.lunar.app, or upon request.

2.6 Time limit

Your Visa Debit card can be used 24 hours a day, except for a few times when the system is updated. We will always notify you well in advance if there is scheduled downtime when the card will not work.

3. Storage of cards and PIN, etc.

3.1 Card

Cards and PINs are personal and may only be used by you personally. When you receive the card, you must immediately sign it on the back using the signature box. The card may not be transferred or left to others. You must store the card and your mobile device securely. Periodically, make sure the card or associated mobile device has not been lost.

3.2 Power of attorney

Cards and PINs may only be used by you personally.

If you are over 18 years of age and want another person to have the power of attorney to withdraw money from your account using a card, they must have their own card and PIN. The person's use of the card is according to the same rules that apply to you.

If you no longer want the person to be able to withdraw money from the account, the power of attorney must be revoked in writing to Lunar Bank. The physical card must be returned or destroyed, and the Visa Debit on mobile must be deleted.

3.3 PIN

When ordering a new card, you will have to select your own PIN in the app. You can at any time find your PIN in the app.

You should memorise the PIN. You may not disclose your PIN to anyone else or let others know the PIN.

4. Verified by Visa

Verified by Visa is additional protection against misuse of card data when purchasing on the Internet. The security system requires that when you make purchases on the Internet, in addition to the card, you use 3D Secure. 3D Secure should only be used for purchases in Internet stores using Verified by Visa. If you are not signed up for Verified by Visa, you will not be able to shop in particular stores.

4.1 Registration

We automatically register your card for Verified by Visa. Make sure your contact information is correct so you can use 3D Secure.

4.2 Changes

If you wish to change/unsubscribe your mobile phone number, please change your contact information in the Lunar app.

4.3 Specifics about the card and the registered mobile phone

As your mobile phone becomes part of the security of Internet purchases in stores using Verified by Visa, you need to ensure that others do not have access to both your card and your mobile phone unhindered. Therefore, you must change/unsubscribe from verified by Visa as soon as possible if you lose the mobile phone on which you receive one-time codes. If you lose the card at the same time, you must also block this; please refer to section 9.

5. Using the card

Before approving a payment or withdrawal, always make sure that the amount is correct on, for instance, the terminal. Payments that you have approved cannot be revoked. However, see sections 7 and 8 concerning the possibility of reversing a payment. You can use the card in the following ways:

  • using the chip or magnetic stripe and PIN
  • using the chip or magnetic stripe and a signature
  • by using the card number, date of expiration, and CVC control number (on the Internet, etc.)
  • by using the chip or magnetic stripe in self-service machines without a PIN
  • using the contactless function
  • using Visa Debit on mobile

5.1 With PIN

When you enter your PIN, make sure that others cannot peep and see the digits.

5.2 With signature

Never sign a note:

  • if the amount is not specified, or
  • if the amount is incorrect. If you allow a business to withdraw extra money from your card, for instance, gratuity, make sure that the business provides a receipt for the full amount.

When you use the card to rent a car or check-in at a hotel, it is customary for you to be asked to sign a note that allows the rental company or hotel to subsequently withdraw additional amounts, to cover, for example, damage to the rented car. Please note that this will allow the rental company or the hotel to withdraw from your account afterwards. There is no balance check on a later draft, so your account can be overdrawn in these cases; also see section 7.

5.3 Purchases on the Internet, etc.

When using the card for internet purchases, you must specify the card number, the card’s expiration date, and the CVC control number. Also, if the business is registered with Verified by Visa, you must use 3D Secure in connection with the purchase. When using the card for purchases by mail and telephone, you must provide the card number, the card's expiration date, CVC control number, and any name and address. For mail-order purchases, you must also sign the order form.

You must never provide your PIN in connection with purchases over the Internet or in connection with mail or telephone order purchases. Never provide your account number when using the card.

5.4 Self-service machines without PIN

In some self-service machines, you can use the card without entering the PIN or signing. In these machines, you accept the transaction when you insert your card into the machine or when you subsequently press approve.

5.5 Receipt

You should always make sure that you get a receipt when making a purchase or withdrawal. The receipt must show, among other things, the date, amount, and part of your card number.

You must ensure that the amount is in accordance with the payment or purchase and that the correct date is stated.

You should save the receipt until you have verified that the correct amount has been charged to your account; please see section 5. It may happen that when purchasing from self-service machines, you will not receive any receipt.

5.6 Subscription

When you use your card number to pay for continual service, such as a subscription, you must ensure that any termination of the subscription is made in accordance with the terms set out by the business.

As a customer, having your VISA card renewed enables the merchant to automatically update your card information using VISA Account Updater. This means you won't have to re-register your new card at the merchant. Please be aware that this only applies to the cases where the merchant supports this specific service. Furthermore, your card must be renewed entirely.

5.7 Gambling and lottery

When you use the card at businesses that predominantly offer games and betting, including casinos, lottery ticket dealers, racetracks, and the like, there may be a restriction on card usage.

The restriction may be as follows:

  • an amount limit per day or
  • that the card cannot be used for gambling or lottery

Information about this can be obtained from Lunar Bank. If you are under the age of 18, you may not participate in such gambling.

5.8 Purchases using contactless payments

You can use the contactless payment feature when purchasing in stores that offer this service. You can use the card without inserting the card into the terminal, entering your PIN, or signing, or you can use Visa Debit on mobile. You accept the payment by holding the card or mobile phone close to a terminal (a distance of 0-3 cm) that has enabled the contactless feature. The contactless feature is displayed on the terminal by this symbol:

You decide whether you want to use the contactless payment feature on the physical card, or if you want to use the card's chip/magnetic stripe and PIN.

5.9 Prior registration of card data

You have the option to register your card data with each business or with a digital wallet provider so that in the future, you do not have to enter your card data when you approve the transaction. You must follow the instructions from the business or wallet provider.

You can also agree with the business that your card data is stored at the store for the purpose of paying for continual service, for instance, a subscription. The business will withdraw the agreed amounts, and you will not have to approve the individual payment.

As a customer, having your VISA card renewed enables the merchant to automatically update your card information using VISA Account Updater. This means you won't have to re-register your new card at the merchant. Please be aware that this only applies to the cases where the merchant supports this specific service. Furthermore, your card must be renewed entirely.

5.10 Registration of your Visa card with Apple Pay or Google Pay

If you have registered your VISA card with Apple Pay or Google Pay, you must take all reasonable precautions to protect the unit/smartphone, in the same manner as the customer would protect payment instruments such as cards and cash. For instance, you must refrain from leaving the unit/smartphone connected to Apple Pay or Google Pay to other persons. Further, the personal code and other security details (hereunder Touch ID and Face IC) are strictly confidential and shall not be shared with others. It is also important that you refrain from including other persons' Touch ID or Face ID on your unit/smartphone

6. Checking transactions in your account

You are required to check the transactions in your account continually. If, at the time of verification, you discover transactions that do not match your receipts or you do not believe you have made, please contact Lunar Bank as soon as possible. In this regard, you should be aware of the deadlines set out in sections 7 and 8.

When continually checking transactions in your account, be aware that when you use the card for purchases over the Internet or use it for mail or telephone orders, the business may not, as a rule, withdraw the amount until the item is shipped. However, when buying, for example, airline tickets or concert tickets, the business already withdraws the amount when booking the trip or booking the concert ticket.

6.1 Notification

Lunar Bank will notify you of suspected or actual instances of misuse or security threats. For example, the notification can be made by telephone, notification in the Lunar app, or any other secure procedure.

7. Reversal of payments that you have approved

7.1 If you did not know the final amount at the time of approval

If you did not know the final amount when you approved the payment and the amount subsequently withdrawn from your account is significantly higher than could reasonably be expected, you may be entitled to a refund of the payment. This may occur, for example, in connection with car rental or check-out from a hotel, where you have approved that the business can subsequently withdraw funds for, for instance, refuelling or consumption of items in the minibar.

You must contact Lunar Bank no later than eight weeks after the amount has been withdrawn from your account if you believe that you are entitled to a refund of a payment where you have not approved the final amount.

7.2 Internet purchases, and mail and telephone orders

If you have used your card to purchase goods or services in one of the following ways:

  • purchase on the Internet
  • purchase by mail or telephone order
  • purchases in self-service machines without a PIN, you may be entitled to have a payment reversed if:
  • the business has withdrawn a higher amount than agreed,
  • the ordered item/service has not been delivered
  • before the goods or services have been delivered, you exercise an agreed or statutory right of withdrawal. You must first try to resolve the issue with the business before contacting Lunar Bank.

You must be able to prove that you have contacted or attempted to contact the business. It is a condition that you approach Lunar Bank with your objection as soon as possible after you have become aware that an amount has been improperly withdrawn from your account and you, therefore, wish to object. As far as possible, you must object to Lunar Bank within 14 days of becoming aware of your possible claim. When assessing whether you have objected to Lunar Bank in a timely manner, your obligation to continually review entries in your account will be emphasised; please refer to section 6.

Lunar Bank will then conduct an investigation into your objection. While your objection is being investigated, the disputed amount will usually be deposited into your account. If the objection subsequently proves to be unwarranted, Lunar Bank will again withdraw the amount from your account.

If your objection is found to be unwarranted, Lunar Bank may charge interest for the period during which the amount was deposited into your account and until the amount is withdrawn again, as well as any fee for requesting a receipt. Please refer to the price list in the Lunar App, on www.lunar.app, or request it from Lunar Bank.

7.3 Objection to a Visa Debit payment

Once you have paid with Visa Debit, you may in some situations have a payment reversed. You can get information on this on the website Nets cardholderclaims, or by contacting Lunar Bank.

8. Reversal of payments that you have not approved

If you believe that one or more payments have been made with your card that you have not approved or made, please contact Lunar Bank as soon as possible after you become aware of the unauthorised transaction. When assessing whether you have timely notified Lunar Bank, your obligation to review transactions in your account continually will be taken into account; please refer to section 6. In any case, please contact Lunar Bank no later than 13 months after the amount is drawn on your account.

Lunar Bank will then conduct an investigation into your objection. While your objection is being investigated, the disputed amount will be deposited into your account. If the objection subsequently proves to be unwarranted, Lunar Bank will again withdraw the amount from your account. If the investigation shows that there is an unauthorised use of the card by others, Lunar Bank may hold you liable; please refer to section 10.

If your objection is found to be unwarranted, Lunar Bank may charge interest for the period during which the amount was deposited into your account and until the amount is withdrawn again, as well as any fee for requesting a receipt. Please refer to the price list in the Lunar App, on www.lunar.app, or request it from Lunar Bank.

9. Your duty to block the card

You must contact Lunar Bank as soon as possible to block your card, or block it in the Lunar app if:

  • you lose your physical card
  • you lose your mobile device with Visa Debit on mobile, or
  • someone else gets to know your PIN
  • you discover that the card has been misused
  • you suspect that the card has been copied, or
  • otherwise, suspect that the card may be misused.

Once the card has been blocked, you will receive a notification, stating the reason and time of the blocking, depending on whether you or Lunar Bank that cause blocking. Blocking your physical card means you will not be able to use your Visa Debit on mobile either.

When we are notified that you have lost your mobile device, your Visa Debit on mobile on this device will be blocked. This will not immediately affect your physical card. If a blocked card is rediscovered, contact Lunar Bank and agree on how to proceed.

10. Your liability for misuse of the card

In the event that the card has been misused by another person, Lunar Bank will cover the loss unless this is covered by sections 10.2-10.6 below. The onus is on you to prove that the loss is covered by sections 10.2-10.6.

10.1

If the card and PIN have been misused by another person, you are liable for losses up to DKK 375. You will have to pay a maximum of DKK 375 in total if several of your cards with the same PIN are misused in connection with the same event. However, this assumes that all cards are blocked at the same time.

10.2

You are liable for losses up to DKK 8,000 in the event that the card has been misused by another person and the PIN has been used, and

  • you have failed to notify Lunar Bank as soon as possible after becoming aware that the card was lost or that unauthorised persons have learned the code
  • you have provided the code to the person who used the card unauthorised without you realising or you should have realised that there was a risk of misuse
  • reckless conduct has enabled the unauthorised use.

However, you will pay a maximum of DKK 8,000 in total if several of your cards with the same PIN have been misused in connection with the same event. This presumes that all cards with the same PIN are blocked at the same time.

10.3

You will be liable for the full loss if the PIN has been used in connection with the misuse under the following conditions:

  • You provided the PIN to the individual who misused the card, and you realised or should have realised there was a risk of misuse.

10.4

You will also be liable for the full loss if you have acted fraudulently or have deliberately failed to fulfil your obligations under the rules, including to store the card and mobile phone with Verified by Visa properly, cf. section 4, to protect the PIN, cf. section 5, or to block the card, cf. section 9.

10.5

If you have several cards with the same PIN, the unlimited liability under sections 10.5 and 10.6 applies to each card that is misused.

10.6

You are not liable for any losses that occur after Lunar Bank has been notified that the card is to be blocked. You will also not be liable for any losses if you have not been able to block your card due to circumstances Lunar Bank is responsible for. You will not be liable if the loss, theft, or unauthorised acquisition of the personal security solution could not be detected by you prior to the unauthorised use.

11. Lunar Bank's rights and liabilities

11.1 Lunar Bank's right to block the card

Lunar Bank is entitled to block the use of the card if:

  • the account to which your card is linked has been cancelled
  • you are violating the rules, including if the account to which the card is linked, is overdrawn, the card has been misused or is presumed misused by third parties.

In the case of an overdraft, you will receive a written notification before the card is blocked. However, immediate blocking may be necessary in the case of particularly significant and/or repeated overdrafts.

Lunar Bank may also require all physical cards linked to the account to be returned and all Visa Debit for mobile deleted. Once Lunar Bank has blocked the card, you will be notified of this, stating the reason and time of the blocking.

11.2 Replacing the card

Lunar Bank has the right to replace the physical card at any time. Replacing your physical card may result in you having to download a new Visa Debit on your mobile.

11.3 Lunar Bank's liability

Lunar Bank shall be liable for damages if, due to errors or omissions, the bank fulfils agreed obligations too late or inadequately. Even in areas where stricter liability applies, Lunar Bank is not liable for losses caused by:

  • breakdown/lack of access to IT systems or damage to data in these systems attributable to the events listed below, whether it is Lunar Bank or an external supplier in charge of the operation of the systems
  • failure of Lunar Bank's power supply or telecommunications, legislative intervention or administrative acts, natural disasters, war, rebellion, civil unrest, sabotage, terror or vandalism (including computer viruses and hacking)
  • strike, lockout, boycott or blockade, whether the conflict is directed against or initiated by the Lunar Bank or their organisation, and regardless of the cause of the conflict. This also applies when the conflict affects only parts of Lunar Bank
  • other circumstances beyond Lunar Bank's control. Lunar Bank's disclaimer of liability does not apply:
  • if Lunar bank should have foreseen the circumstance that is causing the loss at the time the agreement was concluded or the bank should have avoided or overcome the cause of the loss,
  • if, in any event, the legislation makes Lunar Bank liable for the cause of the loss.

11.4 Labour disputes

You cannot use the card in Sweden if Lunar Bank and/or their data centres are involved in a labour conflict. At the beginning and end of such a conflict, you will be notified of this as soon as possible, among other things, through advertising in the daily press.

You cannot expect to be able to use the card outside Sweden if one or more of Lunar Bank's data centres and/or if one or more of Lunar Bank's international partners is involved in a labour dispute.

11.5 Defects

Lunar Bank is not liable for any deficiencies, etc. in the services provided by the business. Any complaints about defects in the services provided should be addressed to the business.

12. Expiry and termination

Visa Debit is issued for three years. The card can be used up to and including the time of expiration printed on the card, after which the card is invalid.

Before the card expires, you will receive a new card.

Your Mobile Visa Debit will not be automatically renewed. This means you will need to get a new Visa Debit on your mobile unit when you activate a new physical card.

Expired, terminated, or blocked cards should be destroyed by cutting the card to destroy the magnetic stripe and chip. You will also need to delete your Visa Debit on your mobile unit.

13. Termination

Lunar Bank may terminate the agreement with two months' notice. In the event of termination, a proportionate amount of any fees you may have paid prior to using the card will be repaid to you.

You may terminate the agreement with Lunar Bank with one month's notice.

14. Changing the rules

Changes to the user rules and price list that are to your detriment can be made with two months' notice. Changes in your favour can be made without notice. You will receive a notification of any changes either in writing or electronically (via email or in the Lunar app). You are obliged to ensure that you have access to the Lunar app and to notify Lunar Bank of any changes to your address and/or email address. You are also responsible for not receiving notices of changes if you have not notified changes to your email and/or address and/or do not have access to the Lunar app.

In case of changes to the rules, these will be deemed to have been adopted unless you have notified Lunar Bank before the date of entry into force that you do not wish to be bound by the new rules.

If you notify Lunar Bank that you do not wish to be bound by the new rules, the agreement will be deemed to have ceased at the time of entry into force of the new rules. If you have prepaid a year's fee, a proportionate share of this fee will be repaid.

15. Complaints

If you have any complaints, please contact Lunar Bank. If your complaint is not upheld, you may contact the Danish Financial Complaint Board or the Danish Consumer Ombudsman.

16. New copy of the user rules

If you misplace the user rules or for any reason need a new copy, you can find them in the Lunar app, at www.lunar.app, or by contacting Lunar Bank.

17. Fees

17.1 Lunar Bank Fees

Annual, quarterly, or monthly card fees, card usage fee, possible account fee, possible account statement fee, possible card replacement fee, possible card replacement fee as well as a copy of a receipt, etc. are listed in the Lunar app, at www.lunar.app, or can be requested.

17.2 Fee when using the card

When using the card, Lunar Bank and businesses may charge a fee. Internet stores or foreign businesses that charge you a fee when using the card must make you aware of this before payment is made.

17.3 Conversion rate for use abroad

Purchases and withdrawals abroad are converted into Swedish kroner, cf. the price list in the Lunar app, at www.lunar.app, and must always be calculated in Swedish kroner.

The methods used for currency conversion are described in the price list. Changes in the way the exchange rate is converted will take effect without notice.

There may have been changes in the exchange rate from the time you used your card to the amount is drawn on your account. Similarly, in some countries, primarily outside Europe, there may be more official rates depending on where the exchange rate is obtained.

17.4 Dynamic currency conversion

If you use the card abroad, you may be offered that the business will make a currency conversion before the payment is made. Before you approve this, the business must disclose the fees and exchange rate the business uses for the conversion. You should be aware that the rate used by the business may be different from the rate used in Lunar, and Lunar has no influence on the conversion rate used by the business.

18. Assessment of card applicant

The card is issued on an individual basis.

19. Processing and disclosure of personal data and purchase information, etc.

By accepting these rules and using Visa Debit, you also consent to the processing of your personal data as described below. You can withdraw your consent at any time, but please note that if you do, you may not be able to use your Visa Debit card.

19.1 Processing and disclosure of information about name, address, telephone no., and civil registration number.

The information provided about the name, home address, phone number, and civil registration number, Lunar uses to create the card and in its ongoing administration. The civil registration number will also be used by the bank to provide statutory information to public authorities about deposits in accounts, interest accrual, if any, etc.

19.2 Processing and disclosure of other data

Lunar Bank uses other data, as well as data obtained from bank details, data from credit reference agencies, etc. as a basis for assessing the issuance of cards, when blocking cards, as well as to ensure the unique identification of the cardholder and for necessary use for the execution of payment transactions.

19.3 Data about use, etc.

When the card is used, the card number, the total transaction amount, the date of use of the card, and where the card was used are recorded. The payee will forward this data to Lunar Bank via Nets.

The data is stored by the payee, Nets, and Lunar Bank and is used in the posting, for billing/bank statements (including access for the cardholder to view usage via the Lunar app), and any subsequent debugging.

Moreover, the data mentioned above is disclosed only where required by law and/or for the purposes of legal proceedings about claims established using the card.

When registering for Verified by Visa, your mobile number is stored at Nets for use by 3D Secure.

19.4 Storage of data

Personal data, as well as purchase data, is stored at Lunar Bank and is physically present with their data centre.

In the event of termination of the customer relationship, the data shall be retained for as long as it is necessary for the possible disclosure of the data to public authorities.

19.5 Reporting to credit reference agencies

If a judgement has been handed down on the cardholder/account holder for default, or the first bailiff court meeting has been held, the cardholder's/account holder's name and address may be reported to Experian Information Solutions (formerly RKI - Ribers Kreditinformation), Swedish UC registry and possibly other credit reference agencies.

20. Supervision

Lunar Bank is subject to the supervision of the Danish Financial Supervisory Authority (FSA) and is included in the FSA's register of companies under the supervision of FSA. no. 28002.

Glossary

Abroad:
Rest of the world not defined under "Sweden".

Business:
All shops, hotels, restaurants, or other places that accept Visa Debit payments.

Business day:
All days except Saturdays, Sundays and public holidays, the Friday after Ascension Day, Constitution Day, Christmas Eve, and 31 December.

Contactless function:
Payment with a contactless card can be made without physical contact with the card terminal. You pay/use the card by holding the card at a distance of 0-3 cm from the terminal's symbol for the contactless function (see below). It is a prerequisite that the business uses card terminals with contactless technology, cf. the symbol below.

You will occasionally be asked to use chip and PIN.

You can only pay in this way with cards bearing the symbol of the contactless function. If your card has the contactless function, it will have the symbol on the front of the card. You can pay small amounts with the contactless function without using the PIN. Symbol:

Digital wallet:
A "Digital Wallet" is a personal software-based solution that can be used for online purchases in an online store. In the digital wallet, you can register your Visa Debit in order to subsequently be able to retrieve card data in an easy way, and then complete a card payment transaction. Transactions are conducted according to the agreement you have entered into with the provider of the digital wallet.

Dynamic currency conversion:
Used by some stores and ATMs abroad, so that you can pay in Swedish kroner. It is the business that makes the currency conversion, and Lunar Bank has no influence on the rate used for conversion.

Issuer:
The financial institution where you have ordered your Visa Debit card (Lunar Bank A/S).

NemID:
NemID is a digital signature. There is a technical distinction between BankNemID and OCES NemID, but you can use both types to sign up for Verified by Visa.

Nets:
Nets A/S – the company that manages the Visa Debit system for the financial institutions.
